When trying to hold your family together, it is important to work with Child Protective Services. They may suggest for you to follow a voluntary plan instead of going to court. The idea of this plan is that it is voluntary and your family is not forced to follow the plan, but it is in your best interest. During this plan, your family may be asked to enter counseling, rehabilitation classes, and even asking one parent to leave the home if domestic violence is an issue. If your family can complete this plan successfully over a given period of time, your children will not be removed from their home and your case may be resolved. A ten-year-old boy's brutal death at the hands of his stepfather could have been avoided after it was revealed the boy called 911 twice in the past year to report abuse. Abdifatah Mohamud, from Buffalo, New York, was found beaten to death in his family's basement last week. He was bound, gagged and struck repeatedly with a rolling pin. Though the Buffalo Police Department is investigating how officers handled the calls, they did confirm they reported the allegations to Erie County Child Protective Services -- who are accused of not doing enough to help the boy or remove him from the home. They are refusing to comment on the case. A police department spokesman says the police commissioner ordered the investigation into 911 calls made in April 2011, when Abdifatah told authorities his stepfather Ali-Mohamad Mohamud was abusing him. Officers responding to a missing child report last week found the boy's body. The 40-year-old security guard has pleaded not guilty to a second-degree murder charge. The Buffalo News said that the officers who responded to the 911 calls immediately reported the allegations to Erie County Child Protective Services and made a domestic incident report, which they also passed on to CPS. The agency failed to remove Abdifatah from the home after this report. Peter Anderson, spokesman for Erie County Executive Mark C. Arizona's child welfare agency is prohibiting the father of a missing Tucson girl from having any contact with his other two children, but authorities say that doesn't mean he's a suspect in her disappearance. Meanwhile Monday, police released transcripts of some of the 911 calls made after 6-year-old Isabel Mercedes Celis was discovered missing last month. In one of the calls, her father, Sergio Celis tells an operator that he believes "she was abducted from my house." The dispatcher asks Celis why he thinks the girl was abducted. "I have no idea," he said. "We woke up this morning and went to go get her up, start her baseball game and she's gone. I woke up my, my sons, I, we looked everywhere in the house and my oldest son noticed that her window was wide open and the screen was laying in the backyard. We've looked all around the house." Police confirmed earlier Monday that the state's Child Protective Services agency has ordered Sergio Celis to stay away from his two sons, citing a need to ensure the boys' welfare. Neither police nor CPS officials would elaborate. Tucson Police Chief Roberto Villasenor said at a news conference that Isabel's older brothers are "with their mother" and have "not been taken away" by CPS. He noted Sergio Celis is cooperating with the agency's order. "He's voluntarily agreed with CPS to stay away from the children," Villansenor said. "We can't talk about other details." May 2007. SECRETIVE CPS GAVE KIDS TO DAD DESPITE 'HISTORY OF VIOLENCE'. Laurie Roberts. In January 2006, Jamie Hallam sent her children to stay with their father for a few days. She never saw them again. According to police and court records, Child Protective Services told the father not to return the children. This, despite the fact that a judge had denied him any access to his kids, citing a history of domestic violence and drug use. Now the children are dead and the father and his girlfriend are in jail and CPS is left to explain why its workers overrode the judge's decision, essentially putting the kids into the arms of the man who stands accused of murdering them. Oh, never mind. I forgot. CPS doesn't have to explain. The law allows the agency its secrets. In March 2006, Hallam asked police for help in getting her children back but a CPS supervisor told officers to leave them with Payne. According to police, the supervisor said CPS was investigating the mother, who had been "uncooperative." "She felt it would be best that the children stay with their father until a hearing could be set and final determination of custody could be settled then," the police report says. It's hard to understand how she could feel that way. Social workers do not work under the same rules and guidelines as police officers. Even though they may have police escort them to a home, they can legally enter and search your home without a warrant. Their job is to look for safety and welfare issues with the child and home. This is can range from drugs or alcohol within reach of the child to evidence of physical abuse. This can happen if the social worker believes there is a real and immediate danger to the child.
